I. General Terms and Conditions
§ 1 Basic Provisions

The following terms and conditions apply to contracts concluded between you and us as the provider (peha-bestgliders GmbH) via the website https://www.ask-pack.de. Unless otherwise agreed, any terms and conditions of your own are expressly rejected.

A consumer, within the meaning of these provisions, is any natural person who enters into a legal transaction for purposes that are predominantly not attributable to their commercial or independent professional activity. An entrepreneur is any natural or legal person or a legal partnership who, when concluding a legal transaction, acts in the exercise of their independent professional or commercial activity.
§ 2 Conclusion of the Contract

The subject of the contract is the sale of goods.

By placing each product on our website, we make you a binding offer to conclude a contract under the conditions specified in the item description via the online shopping cart system.

The contract is concluded via the online shopping cart system as follows:
The goods intended for purchase are placed in the "shopping cart". You can access the "shopping cart" via the corresponding button in the navigation bar and make changes there at any time.
After clicking the "checkout" or "proceed to order" button (or a similarly labeled button) and entering personal data as well as payment and shipping conditions, the order data will be displayed again in an order overview.
If you use an instant payment system (e.g., PayPal (Express/Plus/Checkout), Amazon Pay, Sofort, giropay), you will be directed either to the order overview page in our online shop or to the instant payment provider's website.
After completing the payment details, the order data will again be displayed for final confirmation either on the payment provider’s website or once you return to our shop.
Before submitting the order, you can check, change (also via the "back" function of your browser), or cancel the order.
By submitting the order via the corresponding button ("order with obligation to pay", "buy"/"buy now", "place binding order", "pay"/"pay now", or similarly labeled), you declare the legally binding acceptance of the offer and the contract is concluded. -
Your inquiries for the preparation of an offer are non-binding. We will send you a binding offer in text form (e.g., by email), which you can accept within 5 days unless otherwise specified.

Order processing and communication take place via email and may be automated. You must ensure that the email address provided is correct and that receipt of emails is technically possible and not blocked by spam filters.
§ 3 Special Provisions for Payment Methods
1. Payment via Klarna:
We offer the following Klarna payment options in cooperation with Klarna Bank AB (publ), Sveavägen 46, 111 34 Stockholm, Sweden:

Invoice (“Pay Later”)
The terms for Germany can be found at Klarna Invoice Terms.
Use of Klarna’s payment methods may require a positive credit check. Data is shared with Klarna for this purpose.
2. Payment via PayPal / PayPal Checkout:
When selecting a payment method via "PayPal" / "PayPal Checkout", payment is processed by PayPal (Europe) S.à.r.l. et Cie, S.C.A. Payment methods and any additional terms are displayed during the order process.

§ 4 Right of Retention, Reservation of Title

You may only exercise a right of retention if it involves claims from the same contract.

The goods remain our property until full payment.

If you are an entrepreneur:
a) We retain title until full settlement of all claims from the business relationship.
b) You may resell the goods; claims arising are assigned to us.
c) In case of combination or mixing, we acquire co-ownership proportionate to the invoice value.
d) We release securities upon request if their value exceeds the secured claims by more than 10%.
§ 5 Warranty

Legal warranty rights apply.

Consumers should check goods upon delivery and report obvious defects. Failure to do so does not affect your legal rights.

Deviations from objective product requirements are only agreed upon if previously communicated and explicitly agreed.

For entrepreneurs:
a) Only our specifications and the manufacturer’s product description apply.
b) Warranty is by repair or replacement; after two failed attempts, you may reduce or cancel the contract.
c) Warranty period is 1 year from delivery, except in cases of personal injury, fraud, construction use, or legal recourse.
§ 6 Legal Choice, Place of Fulfillment, Jurisdiction

German law applies. For consumers, this applies only if protection from mandatory consumer law in their country is not withdrawn.

The place of fulfillment and jurisdiction is our business location for merchants, legal entities under public law, or special public funds.

UN sales law does not apply.

6.6 Payments are due immediately unless stated otherwise.
7. Delivery Terms
7.1 Conditions, times, and restrictions are shown on the website.
7.2 Consumers bear no risk during shipping. Entrepreneurs do.
8. Statutory Warranty Rights
Liability for defects is governed by the "Warranty" section of our General Terms and Conditions (Part I).
